Services Description

EagleEye Tracking provides GPS tracking services for vehicles including real-time location tracking, historical route playback, comprehensive reporting, and vehicle monitoring features. Our services are provided through GPS devices, mobile applications, and web-based dashboards.

User Responsibilities

As a user of our services, you agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials
• Use the services only for lawful purposes and in accordance with these terms
• Ensure that you have proper authorization to track the vehicles in your account
• Not attempt to interfere with, disrupt, or damage our services
• Not use the services to violate any applicable laws or regulations
• Notify us immediately of any unauthorized use of your account

Device Installation and Ownership

GPS tracking devices are installed by our authorized technicians or provided for self-installation. The devices remain the property of EagleEye Tracking until full payment is received. Customers are responsible for maintaining the devices in good working condition and must return devices upon service termination.

Payment and Billing

You agree to pay all fees associated with your use of our services according to the pricing plan you select. Fees are charged on a subscription basis and are due in advance. We reserve the right to change our pricing with 30 days' notice. Failure to pay may result in suspension or termination of services.

Service Availability

While we strive to provide uninterrupted service, we cannot guarantee that our services will be available at all times. Services may be temporarily unavailable due to maintenance, updates, or factors beyond our control such as network connectivity issues, satellite availability, or device malfunction.

Data Accuracy

We make reasonable efforts to ensure the accuracy of location data and reports. However, GPS tracking may be affected by various factors including satellite signal strength, weather conditions, and physical obstructions. We do not guarantee 100% accuracy and are not liable for any decisions made based on the data provided.

Privacy and Data Usage

Your use of our services is subject to our Privacy Policy, which is incorporated into these Terms and Conditions by reference. We collect and use location data and personal information as described in our Privacy Policy to provide and improve our services.

Limitation of Liability

To the maximum extent permitted by law, EagleEye Tracking shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our services.

Warranty Disclaimer

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that our services will be uninterrupted, secure, or error-free, or that any defects will be corrected.

Service Termination

Either party may terminate the service agreement with 30 days' written notice. We reserve the right to suspend or terminate your access to our services immediately if you violate these terms or engage in fraudulent activity. Upon termination, you must return any GPS devices provided by us.

Refund Policy

Installation fees and subscription fees paid in advance are non-refundable except as required by law. If you are not satisfied with our services, please contact us to discuss your concerns.

Intellectual Property

All content, features, and functionality of our services, including but not limited to software, text, graphics, logos, and trademarks, are the exclusive property of EagleEye Tracking and are protected by copyright, trademark, and other intellectual property laws.

Modifications to Terms

We reserve the right to modify these Terms and Conditions at any time. We will notify you of any material changes by posting the updated terms on our website or through email. Your continued use of our services after such modifications constitutes your acceptance of the updated terms.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts located in the jurisdiction where our business operates.
